ROBERT A. MOLAN has extensive experience in obtaining, protecting, contracting and/or litigating Intellectual Property rights.
Mr. Molan has written and prosecuted numerous patent applications for inventions encompassing a range of electronic, electrical and mechanical technologies, including products and systems in the medical, automotive, aerospace, traffic control, computer, power generation, tool and Internet fields. He has provided extensive counseling to clients for a wide variety of Intellectual Property matters, and negotiated and drafted numerous licenses and other types of technology agreements involving private and Government rights in patents, trademarks, trade secrets, copyrights and/or software. He has also rendered patentability, registerability, validity, and infringement opinions, worked on interferences, and prepared and prosecuted applications for the registration of trademarks and copyright claims.
Mr. Molan has been lead counsel or otherwise participated in more than 70 lawsuits involving Intellectual Property rights in numerous U.S. District Courts, the Court of Appeals for the Federal Circuit, the Court of Federal Claims, and the International Trade Commission. He has conducted both bench and jury trials and served as a Trial Attorney in the Department of Justice, handling patent and copyright infringement lawsuits involving a variety of products and systems procured by military and civilian Government agencies and corporations. Mr. Molan believes that the insight he has gained in handling these litigation matters has helped him to better counsel and serve clients in other areas of Intellectual Property.
During law school, Mr. Molan clerked with the New York City Intellectual Property firms of Brumbaugh, Graves, Donohue & Raymond and Morgan & Finnegan. After graduating from law school, he was associated with Morgan until he joined the Department of Justice in Washington D.C. Upon leaving Justice, Mr. Molan was of counsel to, and then a partner in, the D.C. Intellectual Property firm of Cushman, Darby & Cushman until its merger with a large general practice firm, whereupon Mr. Molan joined Nixon & Vanderhye as a shareholder. After graduating from engineering school, Mr. Molan worked for a number of years as an electronic engineer in the Long Island Aerospace Defense Industry.
