James T. Hosmer
Mr. Hosmer has over 30 years of experience in intellectual property litigation covering a wide variety of technical disciplines and issues regarding patent validity, infringement and enforceability, as well as inter partes matters relating to copyrights, trademarks, unfair competition and trade secret misappropriation. He has served as lead and co-counsel in literally dozens of federal district court actions, including numerous jury trials and as counsel in Section 337 investigations before the International Trade Commission. Over the years, he has handled numerous appeals from federal district court actions, including appeals to U.S. Court of Appeals for the Federal Circuit and other appellate courts.
Apart from litigation, his practice involves extensive licensing and intellectual property counseling, including venture capital investments and due diligence investigations relating to IP issues. He also has over 30 years of experience in trademark and patent prosecution, including appeals to the PTO Board of Appeals and Interferences, reexaminations, reissue proceedings and inter partes proceedings before the Trademark Trial and Appeal Board.
Mr. Hosmer graduated from the University of Arizona in 1970 with a B.S. cum laude in Chemical Engineering. Between 1970-1973 he worked as a process design engineer for Union Carbide Corporation in New Orleans, Louisiana. He received his J.D. magna cum laude from The American University Washington College of Law in 1976 and was a member of Law Review and Law School Honor Society. He worked full time during law school as a law clerk for the United States Consumer Product Safety Commission. After law school, Mr. Hosmer served as a clerk to The Honorable J. Walter Yeagley, Associate Judge of the District of Columbia Court of Appeals and entered private practice in 1977. He became a partner in the patent firm of Cushman, Darby & Cushman in 1983 and was a founding member of Nixon & Vanderhye P.C. when it formed in December 1985.
Mr. Hosmer is admitted to practice before the bars of Virginia and the District of Columbia and the U.S. Patent and Trademark Office. He is also a member of numerous federal district and appellate courts, as well as the American Bar Association, the American Intellectual Property Law Association, the Federal Circuit Bar Association and the Bar Association of the District of Columbia.
