Nixon Vanderhye is proud to announce that a number of its partners were recognized in Patent Buddy's 2011 Top Patent Prosecutors Survey. Out of approximately 40,000 registered patent attorneys, less than 2% were selected for this achievement. NV helps independent inventors and startup business protect their IP
NV prepared patent applications for a non-drug treatment for hypertension which sold by Ardian Inc. in late 2010 to Medtronic for $800 million. NV prepared provisional and a non-provisional patent applications for independent inventors from which issued U.S. Patent 7,162,303 for renal nerve stimulation. The inventors sold their patent rights to Ardian who created a larger patent porfolio that was sold to Medtronic. NV did not prosecute or prepare applications for Ardian. The sale of Ardian to Medtronic was reported as the highest price paid for a medical device startup company. The technology developed by Ardia is the top Medical Innovation for 2012 as found by the Cleveland Clinic.
N&V creates law in trademark jurisdictional dispute:
In a groundbreaking decision extending the Supreme Court's recent MedImmune decision to trademark cases, N&V Bob Adams and Michael Crawford successfully argued that the "reasonable apprehension of imminent suit" test for determining declaratory judgment jurisdiction is not the appropriate legal test in trademark cases. In Surefoot, L.C. v Sure Foot Corp., 87 U.S.P.Q.2d 1266 (10th Cir. 2008), the appellate panel held that MedImmune cannot be limited to patent cases or to cases in which the parties are in privity. The Tenth Circuit also reversed the decision of the lower court by holding that TTAB oppositions in combination with earlier threats of litigation may establish Article III jurisdiction.

Nixon & Vanderhye wins another jury trial resulting in a multi-million dollar judgment for its client following 3 week jury trial:
N&V trial team (led by Joseph S. Presta and Robert W. Faris) proved to the jury that a family of two-stroke marine engines manufactured by Mercury Marine, a Division of Brunswick Corporation, infringed a patent owned by Electromotive, Inc., a small speed shop in Manassas, VA. N&V's client was awarded 3 million dollars. The case was tried in the U.S. District Court for the Eastern District of Virginia (Alexandria Division) with Judge Lee presiding over the jury trial. The case was settled on favorable terms following the verdict and prior to appeal.

Nixon & Vanderhye wins $39 million dollar judgment for client in patent-based antitrust case following 5 week jury trial:
N&V trial team (led by Robert A. Rowan and Joseph S. Presta) proved to the jury that a family of patents dating back to 1989 and relating to the casino table game Caribbean Stud was obtained by knowing and willful fraud on the U.S. Patent and Trademark Office. Mikohn Gaming Corporation, through its subsidiary, Progressive Games Inc. brought a patent infringement suit against N&V's client, Prime Table Games and its owners, Derek Webb and Hannah O'Donnell, alleging that their casino table game Three Card Poker infringed certain of the patents in the family. The jury agreed with N&V that the infringement claim constituted Walker Process fraud, sham litigation based on inequitable conduct in the mother patent, and sham litigation based on a baseless infringement suit. N&V also proved all other elements of attempted monopolization, resulting in the jury finding a Sherman Act violation on all three independent bases. N&V's client was awarded 39 million dollars plus attorneys fees. The case was tried in the U.S. District Court for the Southern District of Mississippi, with Chief Judge Henry Wingate presiding over the jury trial.
